CJP asks High Court CJs to Nominate one Judge

Chief Justice of PakistanChief Justice of Pakistan Iftikhar Muhammad Chaudhry on Monday asked chief justices of all the five high courts to nominate a judge each for the constitution of special court for the trial of General (retd) Pervez Musharraf under Article 6 of the Constitution by Tuesday (Nov 19) positively.

According to a press release issued by the Supreme Court here on Monday night, the Chief Justice asked Chief Justices of all the five High Courts for nominating a judge each in pursuance of the letter received from Secretary ministry of Law, Justice and Human Rights, Islamabad. On Monday, Federal Secretary Ministry of Law, Justice and Human Rights Zafarullah Khan wrote a letter to the Registrar, Supreme Court that the Federal Government has decided to invoke the powers vested in it under Section 4 of the Criminal Law Amendment (Special Courts) Act, 1976 to establish a Special Court to try General ® Pervez Musharraf under Section 2 of the High Treason (Punishment) Act, 1973.

The letter further stated that the Special Court has to be comprised of three serving judges of High Court, whereas there are five High Courts in the country, therefore, “it will be appropriate that the Apex Court may nominate any three judges of High Courts for constitution of the Special Court.” After going through the contents of the letter, the Chief Justice of Pakistan passed the following order.

“Copy of the letter be circulated amongst the learned Chief Justices of all High Courts viz High Court of Baluchistan, high Court of Sindh, Lahore High Court, Peshawar High Court and Islamabad High Court so that they may each nominate a judge of their respective Court, out of which three names shall before warded to the Government for the Special Court. The nomination may reach this Court on 19.11.2013 positively.” -App
