Govt seeks one-month time to appoint NAB chairman

ISLAMABAD: The federal government, on Wednesday, moved a miscellaneous petition in the Supreme Court (SC), seeking one-month time to fill the vacant post of the NAB chairman.Additional Attorney General (AAG) KK Agha filed an application in the apex court under Rule 2(14) of the Order and Rule 6 of the SC Rules 1980 seeking extension in deadline in implementing the court’s orders.

said that it was not possible for the federal government to initiate the process of appointment of the NAB chairman, adding if the government would appoint new NAB chairman and later found out that its review petition had been allowed then it would be awkward and embarrassing to have two NAB chairmen, which, he argued, was also not permitted under the NAB Ordinance 1999.

He pleaded that it was just and appropriate in circumstances of the case that a review petition on the court’s order against the disqualification of Justice (r) Deedar Hussain Shah as NAB chairman should be taken up for avoiding a conflict / contradicting situation. On March 10, a three-member SC bench, headed by Justice Javed Iqbal, in its short order, had declared the appointment of Syed Deedar Hussain Shah as NAB chairman illegal and ultra vires to the constitution.

The court also directed Shah to relinquish the charge forthwith.Similarly, the court, on March 26, issued its detailed judgment. The petitions challenging the appointment of Shah were filed by leader of opposition in the National Assembly Chaudhry Nisar Ali Khan and Shahid Orakzai. The federation, however, filed a review petition against the verdict on April 9 through senior advocate Abdul Hafeez Pirzada.
