Two women move court for recovery of spouses

PESHAWAR: Two women on Wednesday requested the Peshawar High Court Chief Justice Ejaz Afzal Khan to order recovery of their husbands who were picked up by the local police a few days ago.Clad in traditional burqa, they submitted an application to the chief justice in open court when he was heading a two-member bench and conducting proceedings in different cases. He referred their application to the relevant office and observed that action would be taken on them.The women are wives of two brothers, Mikael Khan and Ali Akber – both labourers and residents of Tambarpura village, Peshawar. They said that 10 days ago Chamkani police raided their residence and took away their husbands.The applicants stated that they had also met their husbands in the Chamkani police station, but now they were shifted to an unknown place. They had also filed a habeas corpus petition before the court of district and sessions judge and the bailiff had visited the police station, but the detainees could not be recovered.The two women applicants told reporters that they belonged to poor families and had eight and four children. They said that in the absence of their family heads it was difficult for them to manage livelihood.Meanwhile, a two-member bench disposed of a writ petition of a missing person after it was revealed that he has been imprisoned in the Peshawar Central Prison.The bench comprising the chief justice and Justice Mazhar Alam Miankhel observed that as the detainee had now been traced the petitioner could move the relevant forum for his release.The petition was filed by a resident of Bara, Jan Muhammad, who alleged that his brother was arrested a few months ago on the order of assistant political agent, Bara, Khyber Agency. Since then, he alleged, that his whereabouts were not known.Deputy attorney general Muhammad Iqbal told the court that they had reports that the detainee was in the prison. He said that the detainee was charged under Section 121 and 122 of PPC and section 11 of the FCR.

In another case, the court allowed time to the ministry of interior for tracing a resident of Charsadda, Khizar Khan, who has been missing since July 2009.A writ petition in this regard was filed by a close relative of the detainee, Jalat Khan. He said that Jalat Khan was taken into custody by a police party, headed by the SP, Charsadda.In a case of another missing person, Hayatmean Khan, the DAG stated that he was in touch with the ministries of interior and defence and he needed more time in this regard.The petition against the disappearance of Hayatmean was filed by his relative, Ibrahim Khan, who stated that the detainee had taken a patient to a doctor in Dabgari area on May 12, 2010. He alleged that he was picked up by officials of an intelligence agency and since then he had been missing – Dawn
