ISLAMABAD: Supreme Court (SC) while suspending transfer orders of chairman CDA issued stay order on this count and ordered that Tahir Shahbaz Shahbaz and Tariq Pirzada will continue to perform duties as chairman CDA and chief commissioner respectively.
A 3-member bench of SC presided over by Justice Jawad S Khawaja took up the case for hearing Monday.Secretary establishment told the court that chairman CDA was transferred under the verbal orders of Prime Minister (PM). Principal secretary of PM while delivering the orders told us that Tahir Shahbaz had repeatedly requested PM for his transfer, she added. On inquiring from the court, chairman CDA told that he had not made any such request.
He was transferred on March, 16 and on the same day he met secretary establishment but he was not informed about his transfer, he further said. .Tahir Shahbaz further told the court that “ I had said this if some thing was done against the rules and regulations then I would not care for my office.As per report presented by secretary establishment, transfer orders of 25 officers of grade, 19,20 and 21 were issued on the last day of the incumbent government. PM is competent authority to issue transfer orders of the officers of grade 21 and above.
Chief Commissioner Tariq Pirzada told the court he had never expressed desire to hold the post of CDA chairman nor had he ever taken interest in it.Secretary establishment told the court that further action would be suspended on the transfer orders which have not been implemented so far.The court while directing principal secretary of PM and CDA chairman to file comprehensive reply put off hearing of the case till Tuesday. – OnlineNews
