ISLAMABAD: Supreme Court of Pakistan has summoned the Chief Secretary Punjab Nasir Mehmood Khosa to explain that why Punjab police is helpless to provide protection to its citizens today (Tuesday).SC summoned the CS Punjab after the Home Secretary’s statement before the apex court that he is helpless to recover the 11 persons, allegedly disappeared from Adyala Jail, held in alleged terrorist attacks on former president Pervez Musharraf in Rawalpindi.Three- member bench of august court headed by Chief Justice Iftikhar Muhammad Chaudhry and comprising Justice Ghulam Rabbani and Justice Khalil ur Rehman Ramday heard the case.Chief justice Iftikhar Muhammad Chaudhry said in his remarks that no one can stand in front of the Constitution, law makes its ways ahead by itself. Chief Justice Iftikhar Chaudhry warned that in case of non-recovery of the missing persons, all the officials concerned would have to go to jail whether it is DCO or Home Secretary.Justice Khalil ur Rehman Ramday in his remarks said that if the government is helpless to protect its citizens then what can do the courts.The court also rejected the holiday’s record of the jail superintendent presented by the IG Jails in SC and showed annoyance over the presenting fake record.Chief justice Iftikhar Chaudhry warned the officials that if missing persons were not recovered all the responsible officials should be ready to face the same treatment. Court also rejected the investigating report of Rawalpindi police.Home Secretary Punjab Shahid Khan contended before the court that the detention order of these accused issued by him and DCO Rawalpindi were legal but chief justice said that it was your professional duty that if you had reservations on court verdict you should have approach the higher court instead reacting beyond the law.
Additional Attorney General K.K. Agha informed the court that he has contacted the intelligence agencies but they replied that accused were not whisked away by any agency.It is worth mentioning here that 11 accused were held by the police in four different cases, including explosive jackets recovery, Pervez Musharaf attack ,Hamza Camp attack and GHQ attack, but all were acquitted by anti-terrorist court and after that Lahore High Court also had acquitted these persons, but after court verdict DCO Rawalpindi and Home Secretary Punjab ordered to keep the accused in detention instead of releasing them.Whereas on last date of hearing SC had ordered the Rawalpindi police to arrest the Superintendent Adyala Jail Saeed Ahmed Gondal and Deputy Superintendent Khalid Bashir who were arrested from the premises of Supreme Court, both officials are on 5 days remand in Secretariat Police Station – Sananews
